Terms and Conditions for EPC /DEA /HCR/ HCS:

Introduction
1.1 This Home Condition Survey ("HCS"),Home Information Pack ("HIP"),Energy Performance Certificate ("EPC") or Home Condition Report ("HCR") agreement ("the Agreement") is made between Hieacymru ("Hieacymru", "We") and the customer ("You").
1.2 By entering into this agreement you are confirming you have read these Terms and Conditions and agree to them.
1.3 Once the confirmation is received you agree to Hieacymru producing a HCS, HIP, EPC or HCR for you ("the Order") and this agreement is legally binding.

2. Your Responsibilities
2.1 You have the legal right to sell the property.
2.2 Information you supply is true and accurate and not misleading. Hieacymru does not take any responsibility for the accuracy of the information supplied and cannot be held liable.
2.3 You will pay the fee quoted within two weeks from the completion and receipt of the HCS, HIP, EPC or HCR.
2.4 You agree to pay any extra costs incurred by Hieacymru to produce the document before the completed HCS,HIP,EPC OR HCR is released including but not limited to: i. obtaining leasehold or commonhold information including management charges imposed on us: ii. inability to gain entry to premises for energy assessment and/or home condition survey/report: iii. customer supplying incorrect information.
2.5 You agree to ensure full access to the property for the energy assessor or surveyor at the agreed date and time. Failure to provide access will result in an extra call out charge.
2.6 You will ensure you have the appropriate software to read PDF files e.g. Adobe Reader.
2.7 You will supply copies of your HCS,HIP, EPC or HCR to interested parties on request and store the master copy.
3. Hieacymru Responsibilities
3.1 We reserve the right to reject or cancel an order at anytime.
3.2 The HIP will contain the compulsory documents as defined by the "Home Information Pack Regulations".
3.3 We will contact you to arrange the EPC /HCR /HCS visit normally within 2 working days of placing the order.
3.4 We will supply the order by an electronic PDF normally within 5 to 10 working days after the energy assessment/survey has taken place. Leasehold and commonhold properties will take longer to produce. However, please allow 28 days or longer in exceptional circumstances.
3.5 We will inform you by email when the order is complete with instructions how to download your HIP /HCS/ EPC/ HCR.
3.6 You may use the HIP/ EPC supplied for any marketing of your property including private advertising or with an Estate/Letting Agent. We will forward a copy of your HIP/EPC to your estate/letting agent on request.
4. Refunds
4.1 A HIP /HCS /EPC /HCR cannot be cancelled after the instruction to commence without Hieacymru incurring costs, as work will have commenced to produce your HIP.
4.2 On cancelling your HIP/HCS the costs incurred by Hieacymru up to that time will be fully reimbursed within two weeks. These costs incurred could include but without limitation ordering an Energy Performance Certificate (EPC), local searches, drainage search, land registry search plus any other work to compile your HIP/HCS.
4.2 The supply of Home Information Packs which includes the EPC is excluded from the distance selling act as they are classed as "goods made to the consumer's specifications or clearly personalized".
4.3 Under no circumstances will our liability exceed the value of the cost of supplying the HIP/ EPC or HCS/R.
4.4 We are not liable for an error in the HIP/HCS based on information including and not limited to from the public register, energy performance certificate (EPC), local searches, information provided by the seller, leaseholder or managing agents.
4.5 This does not affect your statutory rights as a consumer.
